1. Disclaimer of Warranties ("AS IS" Standard)

Crewbric is provided on an "AS IS" and "AS AVAILABLE" basis. Albertastudio expressly disclaims all warranties, express or implied, including:

  • No Guarantee of Continuous Operation: The platform may experience downtime due to maintenance, Supabase/Vercel hosting outages, or network disruptions.
  • No Fitness for Regulatory Compliance: Crewbric is a record-keeping tool. It does not guarantee compliance with OHS, WorkSafe Alberta, WSIB, or any other regulatory body requirements.
  • No Absolute Offline Sync: Data logged offline via IndexedDB may not synchronize if the device is damaged, the browser cache is cleared, or network connectivity fails during sync windows.
  • No Accuracy of AI / Generated Outputs: Any AI-assisted summaries, automated PDF reports, or auto-filled fields are decision-support tools only and must be verified by a responsible site supervisor.

2. Complete Limitation of Developer Liability

To the maximum extent permitted by Alberta and Canadian law, Albertastudio shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including but not limited to:

  • Construction Delays or Fines: Any project delays, penalties, liens, holdback disputes, or regulatory fines arising on any construction site, regardless of whether Crewbric was used to document events.
  • Data Loss or Sync Failures: Loss, corruption, or failure to transmit field logs, GPS records, photo annotations, or time entries due to network issues, hardware failure, or browser cache wipes.
  • Human Entry Errors: Mistakes in crew hours, material quantities, safety incident records, or project notes entered by users.
  • Third-Party Service Failures: Outages of Supabase, Vercel, or any other infrastructure provider used by Crewbric.
  • Business Losses: Loss of contracts, revenue, or business opportunities attributed to software downtime or inaccurate reports.

3. No Refund Policy — All Sales Are Final

ALL SUBSCRIPTION FEES, SETUP FEES, AND PAYMENTS TO ALBERTASTUDIO FOR CREWBRIC ARE FINAL AND NON-REFUNDABLE.

  • Monthly and annual subscription plans — no refunds for unused time
  • Onboarding and setup fees — non-refundable once work begins
  • Trial-to-paid conversions — no retroactive refund after conversion
  • Cancellations take effect at end of current billing period — no prorated refunds

This policy is consistent with standard B2B SaaS practices under Alberta commercial law. Users may cancel their subscription at any time via the Billing settings page.

4. Maximum Aggregate Liability Cap

THE TOTAL AGGREGATE LIABILITY OF ALBERTASTUDIO ARISING OUT OF OR RELATED TO CREWBRIC SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CLIENT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS LOWER.

This limitation applies regardless of whether the claim arises in contract, tort, strict liability, or any other theory, and even if Albertastudio has been advised of the possibility of such damages.

5. Class Action & Collective Lawsuit Waiver

BY USING CREWBRIC, YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION AGAINST ALBERTASTUDIO.

All disputes must be resolved individually. This agreement is governed exclusively by the laws of the Province of Alberta and federal laws of Canada, and subject to the exclusive jurisdiction of Alberta courts.

6. Free Trial Terms (14-Day Trial)

Crewbric offers a 14-day free trial. During the trial period:

  • All provisions of these Terms of Service apply in full, including all liability limitations
  • Albertastudio may terminate trial accounts at any time without notice or compensation
  • Trial data may be deleted 30 days after trial expiry if no subscription is activated
  • No refund is issued if a subscription is started during or after trial and subsequently cancelled

7. Privacy Policy (PIPA Alberta & PIPEDA Canada)

Data Controller: The subscribing company (contractor or crew operator) is the Data Controller responsible for obtaining consent from employees and contractors whose data is entered into Crewbric.

Data Processor: Albertastudio acts as a technical Data Processor only. We do not sell, analyze, or share client field data with any third party for commercial purposes.

Security: All data is transmitted via HTTPS/TLS 1.3. Supabase Row-Level Security (RLS) isolates company records. GPS and photo data remain within the client's organizational data boundary.

Retention: Upon account termination, all data is retained for 30 days then permanently deleted. Immediate deletion requests: hello@albertastudio.dev
